Question about Form I-90
by BethUK 3 Months ago
Application to Replace Permanent Resident Card. Hello, I hope someone will be able to answer my question about this form!

My 3 sons and I, originally from England became LPR in 2005, upon receiving our LPRC's I did not see any information regarding my sons having to re-do their biometrics when they reached the age of 14, or the 30 day window thereafter, if I had of known about this, I would of done it immediately any of them was approaching their 14th birthday and saved myself the higher fee! My son who turned 18 in February needs to get his drivers permit and once he graduates High School next year intends to join the US Marines. Because his original photograph on his LPRC was taken when he was 'younger' he was unable to have a drivers permit issued to him. So I called the Immigration help centre and they informed me about form I-90. My son filled in the form, and checked, what he and I thought was the correct box to check 'g' on Part 2, Question 2, sent it off with the correct fee etc. 2 weeks later we were sent the form back saying he had not checked the correct box, the paragraph below is what was written on the returned letter with the form and fee.

The applicant marked 'g' in Part 2, Question 2, as the reason for filing the Form I-90. The reason requires the applicant to have reached their 14th Birthday since their permanent resident card had been issued and the current card will expire before their 16th birthday. Furthermore, applicants must file the Form I-90 within 30 days of reaching their 14th birthday. Our records show the applicant either has not filed within 30 days of reaching his/her 14th birthday, or the current card expired after the applicant's 16th birthday. you can resubmit the application with the appropriate fee as described on the USCIS internet page.

OK, after reading the above, I called the USCIS helpline and explained to them the situation, also that there was no other box my son could check that would cover the reason for him asking to replace his LPRC. The lady I spoke to said she was not allowed to tell me which box to check, that I would have to ask an Immigration Lawyer! My 3 sons and my LPRC's do not expire until the year 2015, and the only other box I think he could check would be 'e' My name or other biographic information has changed since the card was issued, I assume my sons appearance!

I'm so confused as to what box my son should check, and would really appreciate any help with this one area on Form I-90. My son is so keen to get driving, and also to enlist this year with the US Marines, ready to attend training camp after he graduates next year.

Sincerely, BethUK
